Working as a real estate valuer requires the highest level of professional competence, independence, integrity and sense of responsibility. Appraisal reports and valuations regularly form the basis for economic decisions, court proceedings, financing arrangements as well as tax-related and property-related assessments. Clients, courts, authorities, credit institutions and other market participants must be able to trust that valuations are carried out exclusively according to objective, comprehensible and professionally recognised standards.

This Code of Conduct describes the principles underlying our professional conduct. It forms the basis of our work as independent real estate valuers and documents our commitment to quality, objectivity and lawful action.

The eight duties of professional valuation practice

Eight duties can be derived from the recognised principles of valuation practice, and they govern every valuation. They interlock: the duty of factual investigation supplies the facts, the duty to give reasons makes them verifiable, competence and objectivity secure the professional basis, and clarity, personal performance, concentration and care determine the form and quality of the appraisal report.

1. Duty of factual investigation – establishing the facts in full

All facts relevant to the valuation are established independently and in full. The basis for this is the site inspection covering both the interior and the exterior, together with a review of the official records:

  • Land register extract and cadastral map
  • Building file and register of building encumbrances
  • Standard land values published by the responsible expert committee (Gutachterausschuss)
  • Tenancy agreements and tenancy schedules for let properties
  • Declaration of division and plan of division for condominium ownership

The appraisal report distinguishes which facts have been verified by the valuer and which have been adopted from the client without verification. Suppositions and assumptions, for example about the year of construction, living and usable floor areas or contaminated land, are disclosed and identified as such.

Verified or adopted?

Every value-relevant statement is assigned to one of these two categories. Without that assignment the reader cannot tell how much weight a fact carries in the result.

2. Duty to give reasons – verifiable by a knowledgeable third party

Every valuation input is reasoned in such a way that a knowledgeable third party can review and follow it. The reasoning builds on the established facts and links them to the chosen valuation approach.

The choice of method, comparable prices, the property yield rate, operating costs, the remaining useful life and any additions and deductions are supported by their source and derivation. Blanket statements such as “in the valuer’s experience” are not sufficient.

The calculation is set out in full so that the result can be reproduced arithmetically.

3. Duty to observe the limits of competence – professional and instructed scope

Comment is given exclusively on questions that fall within the valuer’s professional and instructed competence.

Legal questions such as the validity of contracts or matters of succession law, tax assessments and specialist topics such as structural engineering, contaminated land or timber protection are kept outside the scope. Where they are material to the value, specialist reports are obtained from third parties or the open question is treated as a clearly identified assumption.

Fortbildung und Erfahrungsaustausch

Fachwissen wird durch regelmäßige Fortbildung und den Austausch mit anderen Sachverständigen aktuell gehalten. Neue wissenschaftliche Erkenntnisse, technische Entwicklungen und Erfahrungen aus der Bewertungspraxis fließen in die Arbeit ein. Die Teilnahme an Fortbildungen und Veranstaltungen zum Erfahrungsaustausch wird dokumentiert und durch geeignete Nachweise belegt.

4. Objektivitätsgebot – Unabhängigkeit, Unparteilichkeit und Weisungsfreiheit

Die Unabhängigkeit des Sachverständigen bildet die Grundlage jeder Wertermittlung. Bewertungen beruhen auf sorgfältig ermittelten Tatsachen, anerkannten Verfahren und einer eigenständigen fachlichen Beurteilung. Wirtschaftliche Interessen oder Erwartungen von Auftraggebern und Dritten dürfen weder den Bewertungsprozess noch das Ergebnis beeinflussen.

Gutachten werden mit strikter Neutralität erstellt. Gestellte Fragen werden objektiv und unvoreingenommen beantwortet; bereits der begründete Anschein einer Befangenheit ist zu vermeiden. Persönliche, wirtschaftliche, verwandtschaftliche oder durch Schwägerschaft begründete Beziehungen zu Beteiligten werden vor der Auftragsannahme geprüft und offengelegt. Aufträge mit verwandtschaftlichen oder durch Schwägerschaft begründeten Beziehungen zu Prozessparteien oder privaten Auftraggebern werden nicht angenommen. Auch bei anderen nicht auflösbaren Interessenkonflikten wird ein Auftrag abgelehnt oder beendet.

Weisungsfreiheit bedeutet, dass Vorgaben zum Auftragsumfang nicht mit Vorgaben zum Ergebnis verwechselt werden dürfen. Weisungen, Einflussnahmen oder Verpflichtungen, die tatsächliche Feststellungen und fachliche Beurteilungen verfälschen könnten, werden nicht akzeptiert. Ein gewünschter Zielwert wird nicht zur Bewertungsgrundlage; Gefälligkeitsgutachten sind ausgeschlossen.

Maßstab des Verkehrswerts sind die tatsächlichen Gegebenheiten des Bewertungsobjekts und der gewöhnliche Geschäftsverkehr, nicht die subjektive Wertvorstellung eines Beteiligten.

5. Duty of clarity and transparency – structure and comprehensibility

Comprehensible communication builds trust.

The appraisal report is drafted with a clear structure, in unambiguous language and in full. In a logical sequence it contains:

  • The instruction and the purpose of the valuation
  • The valuation date and the quality date
  • A description of the property and its location
  • The choice of method together with the reasons for it
  • The calculation and the result
  • Appendices such as photographic documentation, site plans and official extracts

Clients are informed about the scope of the assignment, the valuation methodology applied and material valuation assumptions. Limitations of the valuation, uncertainties or a lack of information are openly disclosed.

Technical terms are explained and contradictions between the text and the calculation are ruled out. A knowledgeable third party must be able to read and review the appraisal report without having to ask questions.

Valuation results are communicated objectively and are not presented as having greater significance than their actual evidentiary value warrants.

6. Duty of personal performance – personal responsibility

The appraisal report is prepared, taken responsibility for and signed personally by the instructed valuer.

Hilfskräfte wirken ausschließlich vorbereitend mit, etwa bei Recherche, Aufmaß oder Schreibarbeiten, und werden dabei angeleitet und beaufsichtigt. Ihr fachlich erheblicher Beitrag und dessen Umfang werden im Gutachten kenntlich gemacht. Ortsbesichtigung, Verfahrenswahl, Bewertungsentscheidungen und Ergebnisbildung bleiben Aufgabe des Sachverständigen.

Der verantwortliche Sachverständige prüft die zugearbeiteten Inhalte und unterzeichnet das Gutachten selbst und allein. Die Übertragung der fachlichen Kernaufgaben an Dritte oder das bloße Unterzeichnen fremder Ausarbeitungen ist ausgeschlossen. Die Verantwortung für die eingesetzten Mitarbeiter verbleibt beim Sachverständigen.

7. Duty to focus on the essentials – confining the report to what matters

The content is limited to what is material to the instruction and to the value. What counts are the value-determining characteristics: location, size, condition, income as well as rights and encumbrances.

Passages without relevance to the value, unsolicited secondary valuations and lengthy standard text with no connection to the property are left out.

The depth of the work follows the purpose of the appraisal report, for example mortgage lending, the division of an estate, the equalisation of accrued gains or submission to court.

8. Duty of care – the care of a conscientious professional

Jeder Auftrag wird gewissenhaft und mit der gebotenen fachlichen Sorgfalt bearbeitet. Maßgeblich sind der aktuelle Stand von Wissenschaft und Technik sowie die einschlägige Praxiserfahrung. Die tatsächlichen Grundlagen gutachterlicher Aussagen werden sorgfältig ermittelt; Feststellungen, Annahmen und fachliche Schlussfolgerungen bleiben klar unterscheidbar.

The valuation is carried out using suitable and recognised valuation methods, taking into account the relevant statutory provisions, the German Real Estate Valuation Ordinance (ImmoWertV), the guidelines published in this regard, current case law as well as the generally recognised rules of professional valuation practice.

This includes current data and records, verified floor areas and calculation steps as well as results checked for plausibility, both by comparing the methods and against comparable prices from the purchase price collection of the expert committee (Gutachterausschuss). The site inspection is documented carefully.

Findings, assumptions and conclusions are documented in a comprehensible manner and substantiated on professional grounds.

Vertraulichkeit und Schweigepflicht

The trustworthy handling of information is an essential component of responsible valuer activity.

All information obtained in the course of an assignment, as well as personal or commercially sensitive data, is treated confidentially and processed exclusively within the scope of statutory and contractual requirements.

Erlangte Kenntnisse, Unterlagen und Gutachten werden weder unbefugt an Dritte weitergegeben noch für eigene oder fremde Zwecke unbefugt verwertet. Mitarbeiter und mitwirkende Hilfskräfte werden ebenfalls zur Verschwiegenheit verpflichtet.

Die Verpflichtung zur Verschwiegenheit besteht auch über den Abschluss des jeweiligen Auftrags hinaus. Gesetzliche Auskunfts- und Offenlegungspflichten bleiben unberührt.

Lawfulness and compliance

Professional practice is conducted in full compliance with applicable statutory provisions.

This includes, in particular, compliance with data protection requirements, professional obligations and all relevant statutory provisions. Corruption, acceptance of benefits or any other improper influence are incompatible with our professional self-conception.

Quality assurance

The quality of every valuation is of the utmost priority.

Appraisal reports are carefully reviewed before being handed over to the client. Valuation bases, data sources, calculations and conclusions are fully documented and presented in a manner that is professionally comprehensible and verifiable.

The goal of every appraisal is to produce a robust, transparent appraisal report suitable for use in court proceedings.

Verantwortung, Haftung und Versicherung

Real estate valuations carry considerable economic and legal significance. This gives rise to a special responsibility towards clients, courts, authorities, credit institutions and all other parties involved.

Assignments are accepted only if their proper and professional handling can be ensured. The aim is to produce independent and comprehensible appraisal reports that make a reliable contribution to well-founded decisions.
Für die fachliche Richtigkeit und Vollständigkeit der eigenen Leistungen übernimmt der Sachverständige Verantwortung. Dies umfasst auch die sorgfältige Auswahl, Anleitung und Kontrolle der eingesetzten Mitarbeiter sowie deren Beiträge zum Gutachten.

Eine Haftungsbeschränkung für Vorsatz oder grobe Fahrlässigkeit kommt nicht in Betracht. Regelungen zur Haftung bei einfacher Fahrlässigkeit werden nur im Rahmen einer individuellen vertraglichen Vereinbarung und nur insoweit getroffen, wie sie rechtlich zulässig sind. Zwingende gesetzliche Haftungsvorgaben bleiben unberührt.

Zu einer verantwortungsvollen Berufsausübung gehört ein dem Tätigkeitsumfang und den übernommenen Risiken angemessener Berufshaftpflichtschutz. Dessen Umfang und Angemessenheit sind regelmäßig zu prüfen; die Mitwirkung von Mitarbeitern und Hilfskräften ist dabei zu berücksichtigen.
