Unequal co-ownership shares often result from differing financial contributions at the time of original acquisition, for example due to differing amounts of equity capital contributed by the partners.

In calculating the equalization of accrued gains (Zugewinnausgleich), only each spouse's respective share of the property value is considered separately as an asset item.

If joint funds were invested after the acquisition irrespective of the original shares, this can further shift the actual economic participation and should be documented separately.

If the original co-ownership shares were established by notarial deed, these generally remain decisive even if the actual financial contributions have shifted over time.

Only a subsequent notarial amendment of the co-ownership shares can make such a shift legally binding and traceable.
